This Website is operated by Boujee Brush. Throughout the site, the terms “we”, “us” and “our” refer to Boujee Brush. Boujee Brush offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Purchases and Bookings

Upon purchase, you will receive a confirmation email from Boujee Brush which will be taken as proof of your acceptance of these Terms and Conditions, the Privacy Policy, and the data recorded by Boujee Brush and shall be treated as legal evidence of the transaction between Boujee Brush and the Purchaser.

All currency and purchase transactions will be performed in Australian Dollars. Boujee Brush reserves the right to change pricing at any time.

All ticket holders must be 18 years old and over unless specifically outlined in the event description.

Event hours vary and are dependent on the experience booked.

We expect all guests to follow the instructions of the instructor and refrain from speaking over the host, hindering the experience for other guests. Customers must respect the staff of Boujee Brush and the venue where the session is taking place and may be refused entry or asked to leave the premises if they do not follow such terms.

Boujee Brush does not accept responsibility for any losses or damage incurred to personal belongings or clothing. Guests should dress appropriately for the activity.

Guests should not cause damage to any property owned by Boujee Brush or the venue where it is hosted. Guests should also abide by the venue's own terms and conditions.

Boujee Brush in the course of its experiences/events will take images and recordings. By booking with Boujee Brush, you expressly and impliedly authorise and permit Boujee Brush to take images and recordings of you, for the promotion and advertising of Boujee Brush.

Refund and Reschedule Policy

Bookings can be cancelled or rescheduled up to 48hours before a scheduled session time. If cancelling or rescheduling within that 48 hour window a $25 non-negotiable fee per ticket will be applied. When rescheduling, the customer will need to choose the next most convenient session date that is available or Boujee Brush can provide a credit towards a future booking (minus the rebooking fee).

If a customer does not show up for the class, they will still be charged the full amount. We are unable to refund, reschedule or provide credit for a missed session.

Private Functions

Private functions must have the minimum number of tickets booked 14 days before the event. A function can be rescheduled or refunded, (minus the booking fee) up to 14 days before the session date. If the function is rescheduled or cancelled within this 14 day period then a fee of $100 will be charged on the booking. If the full amount has been paid & there is more than 14 days before the session date, we can reschedule your private function to another date that is suitable for yourself and also Boujee Brush. We are unable to refund or reschedule private functions within the 14 days before your session date. The full amount will be forfeited.

Cancellation of session by Boujee Brush

In the event a public or private session is cancelled by Boujee Brush, the ticket purchaser will be notified via email or text message no later than 24 hours prior to their session scheduled start time. Ticket purchasers will be offered a reschedule to another upcoming session or credited the value of their purchase for future use.

Copywrite

All paintings, artwork, photos, graphics, text, video clips, audio clips, slogans, icons, trade names and all other intellectual property contained on our website belong exclusively to Boujee Brush. No permissions are given to use, reproduce, modify, copy, transmit, display, publish, sell, licence, distribute or commercially exploit any of the content or otherwise dispose of any of the content in a way not permitted by us, without our express written consent.

Disclaimer and Limitation of Liability

The purchaser agrees that the provision of any service, including but not limited to public painting sessions, purchased from our website is at the Purchaser’s sole risk. To the full extent permissible by applicable law, Boujee Brush will not be liable for any damages of any kind arising from the use of this site, or from any services provided from this website or establishment, including but not limited to direct, indirect, incidental, punitive, and consequential damages. No oral advice or written information given by Boujee Brush nor its affiliates, nor any of their officers’ directors, employees, agents, providers, or the like, shall create a warranty or legal obligation; nor shall the purchaser rely on any such information or advice.
